Please read these terms and conditions of use carefully before using this site. Using this site indicates that you accept these terms and conditions of use.
Always seek the advice of a qualified veterinary professional with any questions you may have regarding your horse’s medical condition. Do not disregard professional veterinary advice or delay in seeking it because of information on the site. Reliance on any information is solely at your own risk.
1. Changes and updates to Terms and Conditions
Please read these terms of use carefully before using the site. Saratoga Horse RX reserves the right at any time to:
a) change the terms and conditions of this agreement;
b) change any prices, fees and charges associated with this site, information or services;
c) change the site, including eliminating or discontinuing any information or services or other feature of the site; or
d) deny or terminate your use of and/or access to the site.
Any changes Saratoga Horse RX makes will be effective immediately upon or making such changes available on the site or otherwise providing notice thereof. You agree that by entering, re-entering, or continuing to use the site thereafter you accept such changes.
2. Veterinary-Client-Patient Relationship
In accordance with the standards set forth by the American Veterinary Medical Association (AVMA), and by all applicable state and federal laws and regulations, you (the client) agree that by using Saratoga Horse RX’s online shop to purchase prescription items, you have an established Veterinary-Client-Patient Relationship (VCPR) with the prescribing veterinarian.
As defined by federal regulation 21CFR530.3, a VCPR exists when all of the following conditions have been met:
- a veterinarian has assumed the responsibility for making medical judgments regarding the health of (an) animal(s) and the need for medical treatment, and the client (the owner of the animal or animals or other caretaker) has agreed to follow the instructions of the veterinarian;
- there is sufficient knowledge of the animal(s) by the veterinarian to initiate at least a general or preliminary diagnosis of the medical condition of the animal(s); and
- the practicing veterinarian is readily available for follow-up in case of adverse reactions or failure of the regimen of therapy. Such a relationship can exist only when the veterinarian has recently seen and is personally acquainted with the keeping and care of the animal(s) by virtue of examination of the animal(s), and/or by medically appropriate and timely visits to the premises where the animal(s) are kept.
